Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for Electrical Appliance for Commercial Dispensing and Vending.
On 17th October, 2024, the Ministry of Commerce and Industry, through the Department for Promotion of Industry and Internal Trade (DPIIT), issued the Electrical Appliances for Commercial Dispensing and Vending (Quality Control) Order, 2024. This order mandates that all commercial dispensing appliances and vending machines produced, imported, or sold in India obtain BIS certification, in line with public safety and regulatory compliance under the Bureau of Indian Standards Act, 2016.
Key Provisions of the Electrical Appliances for Commercial Dispensing and Vending (Quality Control) Order, 2024
1. Title and Implementation Timeline
This order is officially titled the Electrical
Appliances for Commercial Dispensing and Vending (Quality Control) Order,
2024.
• Effective
Date: April 1, 2024, for medium and large enterprises.
• Small
Enterprises: Compliance required by July 1, 2025.
• Micro Enterprises: Compliance required by October 1, 2025.
2. Mandatory BIS Certification
All electrical appliances for commercial dispensing
and vending must adhere to the Indian Standard IS 302 (Part 2/Sec 75): 2018.
These appliances must bear the BIS Standard Mark (ISI Mark), indicating compliance
with the established safety and quality standards.
· Only
liensed manufacturers may use the ISI Mark, as per the Bureau of Indian
Standards (Conformity Assessment) Regulations, 2018, Scheme-1 of
Schedule-II.
· Exemptions: Goods manufactured for export and up to 50 units
imported annually for R&D purposes are exempt, provided they are not sold
commercially and are disposed of as scrap. Manufacturers must maintain and
furnish records of these imports as needed.
3. Certification and Enforcement Authority
The Bureau of Indian Standards (BIS) serves as the certifying and enforcement authority, ensuring compliance with the order for all commercial dispensing appliances and vending machines in India.
4. Penalties for Non-Compliance
Any individual or entity that violates the provisions of this order will face penalties in accordance with the Bureau of Indian Standards Act, 2016.
