THIS IS THE RECENT UPDATE FOR ALL EXISTING LICENSE HOLDERS, NEW APPLICANTS, MANUFACTURERS, IMPORTERS, AND PRODUCT SELLERS FROM THE MINISTRY OF COMMERCE AND INDUSTRY (DEPARTMENT FOR PROMOTION OF INDUSTRY AND INTERNAL TRADE). IT SPECIFICALLY PERTAINS TO THE BUREAU OF INDIAN STANDARDS QUALITY CONTROL ORDER (BIS QCO) FOR THE DRUMS AND TINS (STEEL DRUMS (GALVANIZED AND UNGALVANIZED)).

The Ministry of Commerce and Industry, specifically the Department for Promotion of Industry and Internal Trade, has issued a significant regulatory measure in New Delhi on October 17, 2023. This regulatory decision is exercised under the authority vested by section 16 of the Bureau of Indian Standards Act, 2016, following thorough consultations with the Bureau of Indian Standards. The government, in its wisdom, deems it essential and expedient to take this action in the broader interest of the public. The resulting regulatory directive, formally known as the Drums and Tins (Quality Control) Order, 2023, is scheduled to become effective six months from the date of its official publication.
The essence of this regulatory directive lies in its stipulation that goods or articles explicitly listed in the accompanying Table must adhere to the prescribed Indian Standard mentioned in the second column of the Table. Furthermore, they are mandated to bear the Standard Mark, and must follow specific Indian Standard 2552:1989, requiring a license from the Bureau of Indian Standards, all in accordance with Scheme-1 of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. According to BIS QCO for the drums and tins (steel drums (galvanized and ungalvanized)), exceptions are granted for goods produced domestically with the intent of export, as well as for goods or articles filled with materials in powder, semi-solid, or liquid form when imported into India.
Adding a layer of nuance, compliance timelines are distinguished based on the scale of enterprises. For micro-enterprises, as defined in the Micro, Small and Medium Enterprises Development Act, 2006, the regulatory provisions will come into force twelve months from the official publication date. For small enterprises, the applicability of these provisions will commence nine months from the date of official publication.
BIS QCO for the drums and tins (steel drums (galvanized and ungalvanized)) in the event of contravention, any individual found to be in violation of the stipulations outlined in this regulatory order will be subject to penalties as per the provisions delineated in the Bureau of Indian Standards Act, 2016.
